Is it legal to buy cannabis seeds online? It depends where you live, and in the US the federal answer is due to change on 11 December 2026 under current law. From that date, viable seeds from a plant over 0.3 percent total THC drop out of the federal hemp definition. State and national law decide the rest.
What the statute says about seeds
Section 781 of Public Law 119-37, approved 12 November 2025, amends the hemp definition at 7 U.S.C. 1639o “effective 365 days after the enactment of this Act.” Its new exclusions list opens with clause (i): viable seeds from a Cannabis sativa L. plant exceeding 0.3 percent total THC, THCA included, on a dry weight basis. The test is the parent plant, not the seed.
Section 2019 of H.R. 6500, now Public Law 119-103, says that until 11 December 2026 Section 781 applies only to products in sub-clauses (1)(C)(ii)(I) and (1)(C)(iv)(I). The seed clause is not one of them.
The line for an online seed order
| When | What Section 781 does to seed |
|---|---|
| Now (30 October 2026) | Not yet in effect |
| From the 365-day mark (November 2026) | In effect for two product sub-clauses only; seed clause held back |
| From 11 December 2026 | Seed clause applies in full, unless Congress acts first |
This desk read both enrolled texts on GovInfo on 30 October 2026. The congress.gov actions page for H.R. 6500, read the same day, shows no action after it became law on 2 September 2026. The act’s continuing appropriations also end on 11 December. It is the date currently enacted, not a promise.
Is it legal to buy cannabis seeds online in your state?
Federal text is half the answer. What a seed becomes once it leaves the hemp definition is a Controlled Substances Act question, set out in our DEA and hemp post. The earlier bills to move the deadline are in our August report, and carriers have their own rules: see mailing seeds through USPS.
Questions buyers ask
Are cannabis seeds legal in the USA?
Federally, the answer changes on 11 December 2026, the date now in enacted law. From then, viable seeds from a plant over 0.3 percent total THC, THCA included, fall outside the hemp definition in 7 U.S.C. 1639o. Each state then applies its own rules on top, so a federal answer is never the whole answer.
Can I legally order cannabis seeds online in the United States?
That depends on your state and on the seed. Before 11 December 2026 the seed clause of Section 781 is not in force. After it, the federal hemp label turns on the THC of the parent plant, not the seed. Shipping rules are a separate question, covered in our carrier posts.
What’s going on with the new U.S. cannabis seed law?
Section 781 of Public Law 119-37, approved 12 November 2025, rewrote the hemp definition effective 365 days later. Public Law 119-103, signed 2 September 2026, then held most of it back until 11 December 2026. Only two product sub-clauses run on the original timetable. Seeds wait for December.
A packet bought this winter is a plan for spring, and the law it lands under is set by your state and your country as much as by Congress. Check your local laws before you order.
