Are very high CBD strain seeds hemp?
The definition at 7 U.S.C. 1639o, read on Cornell’s site on 8 October 2026, counts seed as hemp at not more than 0.3 percent delta-9 THC. Section 781 excludes “any viable seeds” from a plant over 0.3 percent total THC; this site’s statute post has both texts. A strain average is not that plant, and Healthline does not say which THC it measured.
When does the seed rule start?
Section 781 was set to take effect 365 days after its 12 November 2025 enactment. Foley Hoag reports H.R. 6500, signed 2 September 2026, moved federal hemp-THC product restrictions to 11 December 2026. Its post does not mention seeds.
